Description

A Dutch referral has asked the Court of Justice to clarify:

• whether products that meet the definition of a food supplement may subsequently be classified as medicinal products;
• the role of the manufacture’s intention and marketing material in making a classification; and
• Whether online, third-party reviews containing medical claims should be considered in classification of a product .

• Could reshape classification assessments.
• May affect labelling and advertising strategies.
• Could increase monitoring requirements for online sales channels.
